TERMS AND CONDITIONS
By booking ShutterBaby Photography (SBP) for your portrait session, you agree to be bound by the Terms & Conditions set out below.
PAYMENT
Payment of the session fee is due at the time of booking. Payment for all additional products ordered must be made at the time of ordering.
CANCELLATION
Should the Client need to postpone then the session fee will be applied to the new booking. If the Client cancels and does not rebook, then the session fee will be retained by SBP. If SBP has to cancel the session for reasons beyond their control (death, injury, sickness etc.), their liability shall be limited to a full refund of all monies paid.
PHOTO SESSION
SBP shall be granted creative and artistic licence in relation to the choice of locations, backgrounds and poses used. SBP’s judgement on photographic style and the number of photographs taken shall be deemed correct. Some photographs may not be possible due to changes of the weather and the availability and willingness of subjects. SBP will do their best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.
A parent or guardian must be present at all times during the photo session. The Client must not take any photographs without first obtaining permission from SBP.
ORDERING
SBP aims to have the Client’s viewing session/ online gallery within one week of the photo session, but during busy periods this timeframe may be extended. Orders must be made in person at the viewing session or within one week of the online gallery being posted. SBP reserves the right to charge a late payment fee if the Client does not place an order within these timeframes. All images will be archived after a period of 3 months and a retrieval fee of £50 charged.
DELIVERY
SBP aims to have images edited within 14 days of the order being made, but during busy periods this timeframe may be extended. Bespoke products may take longer depending on supplier lead times. Any delay in payment will affect the delivery period.
MARKETING
The Client grants SBP the right to use a Client’s images for advertising and promotion in various media (including SBP’s own website), entry in photographic contests or art exhibitions, editorial use, for the creation of samples or for display within or on the outside of any studio used by the SBP. No names or any other identifying information will be disclosed when using images for these purposes.
If SBP wishes to use any of the Client’s images for commercial purposes where payment is sought or received, such as the sale of images to photographic libraries, SBP will not do so without first obtaining the written permission of the Client.
COPYRIGHT
SBP will own the copyright in all images created. RAW images will remain the property of SBP and cannot be transferred to the Client or purchased. The Client is obtaining images for personal use only. They may not be published or sold without the express written permission of SBP.
The Client may not alter, add to or manipulate an image by any means. Permission to reproduce (e.g. scanning, copying, printing) an image is granted to the Client by SBP only when digital images are purchased.
REFUNDS
If you are unhappy with any products from SBP every effort will be made to rectify the issue. Incorrectly supplied items and items of poor quality can be returned and will be replaced on return of the item. The Client must report the issue in writing within 48 hours of receipt. Returns will not be considered for incorrectly ordered items or items ordered in error. No return, exchange or refund is available on any item once the order has been placed. For digital files no refunds are available once they have been received.
Please note that all computer monitors are calibrated differently and the final print may differ slightly in colour or brightness from what you see on the monitor. SBP takes no responsibility for prints that are ordered by the Client from a low quality printer – to maintain the quality of the image use a reputable printing company.
LIABILITY
In the unlikely event of total photographic failure, injury or sickness beyond SBP’s control, their liability shall be limited to a full refund of all monies paid. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of SBP. In the event SBP fails to perform for any other reason, SBP shall not be liable for any amount in excess of the retail value of the Client’s order.
The purchase of digital files releases SBP from any liability due to future loss or damage of the images and from any obligation to maintain copies of any digital file, image or photograph. It is the responsibility of the Client to ensure adequate back up of digital files.
PRIVACY & DATA PROTECTION
SBP collects certain personal information from the Client in connection with the photo session (e.g. name, email address, home address, phone number). SBP will only use personal information for the purposes of undertaking the services booked by the Client and creating and delivering images and products. Personal information and photographs may be provided to selected partners for retouching services and for the purposes of creating products. SBP will store the Client’s personal information and photographs on their own system but will not disclose any personal information to a third party without the Client’s prior consent.
